Over the last few years, the Texas legislature began enacting statutes to authorize homeowners to file lawsuits against their homeowners associations in Texas justice courts. It started with statutory authority for homeowners in subdivision developments to sue their homeowners associations for failure to produce requested records. In 2021, however, the Texas legislature enacted new statutory laws that allow homeowners to sue a homeowners association that governs a subdivision development for any violations of Chapter 209 of the Texas Property Code in justice court and that also authorizes condominium unit owners to sue a condominium association that fails to produce requested records in justice court. While lawsuits of this nature tend to involve small stakes, they have the potential to be very expensive for a community either in terms of legal fees, payment of deductibles, and/or increased premiums due to insurance claims.  Association Shield helps protect your community by providing a “no-deductible” insurance policy to cover the cost of attorney representation in a justice court lawsuit.
